New York Sues Polymarket for Illegal Gambling Operation

New York Attorney General Letitia James and Governor Kathy Hochul have filed a lawsuit against Polymarket US, alleging the prediction platform is conducting illegal, unlicensed gambling in the state. The lawsuit aims to halt the operations and seeks financial penalties, forfeiture of alleged illegal gains, and restitution.

Polymarket recently re-entered the U.S. market after acquiring regulated exchange infrastructure and claims to operate under federal commodities law. However, New York argues this does not exempt the platform from state gambling regulations. An investigation revealed that Polymarket allowed users to wager on sporting events without a New York gambling license and exposed users under the legal gambling age of 21 to these markets.

The lawsuit requests a court to prevent Polymarket from continuing its alleged unlicensed gambling activities. This case underscores a broader jurisdictional issue faced by prediction markets, where federal and state regulators may interpret the same products differently. While the lawsuit does not yet prove Polymarket has violated the law, it raises significant implications for the future of prediction markets as they evolve into mainstream consumer products.
